Investing in the stock market and wondering if you'll receive a PIT-8C form? This question comes up frequently, because whether you receive this document determines how easy it will be to prepare your annual tax return. Whether you use a Polish or foreign broker is crucial.

Polish broker: PIT-8C and simple settlement

With a Polish broker, things are very simple. At the end of the year, you'll receive a PIT-8C form—an official summary of your income, expenses, and other data needed for tax settlement.

In practice, this means that the tax office immediately receives information about your investment results, and you simply confirm the figures in your annual tax return. You don't need to perform any additional calculations or analysis – the documentation is already prepared and at your fingertips.

Foreign broker: no PIT-8C and obligation to calculate independently

With a foreign broker, the situation is completely different. You won't receive an official document similar to the PIT-8C. While some foreign brokers do provide a yearly summary in a form that (at first glance) resembles the PIT-8C, these are merely informal reports.

In this case, the safest option is actually to download the history of all transactions yourself and calculate based on that:

  • revenues,
  • costs of obtaining revenues,
  • profits or losses.

This means more work and greater responsibility on your part, because the entire process is based on data that you have to collect and analyze yourself.

Where does the problem arise? The quality of reports from foreign brokers.

As mentioned above, at first glance such reports may look similar to the Polish PIT-8C – they often contain statements of revenues, costs and profits.

There's a fundamental difference, however: these are unofficial documents. Brokers are not obligated to submit them to the Polish tax office. Furthermore, each broker creates them according to their own rules, and their accuracy is not verified in any way.

In practice, many investors copy data from such reports into their PIT-38 tax forms, as this seems like the simplest solution. However, this can lead to errors in settlement if the report is not prepared in a manner consistent with the calculations required under Polish regulations.

Therefore, it is safer to calculate all the values ​​yourself in accordance with Polish regulations, instead of relying solely on what the foreign broker's system "spits out".
