The taxation of cryptocurrencies and digital assets, broadly defined, is one of the most dynamic and complex areas of tax law. At BTTP, we have been providing tax advice on cryptocurrencies since 2017, when we obtained the first groundbreaking administrative court rulings in Poland regarding the non-taxation of crypto-crypto exchanges. In an era of widespread adoption of blockchain technology, DeFi (decentralized finance), and tokenization, traditional tax systems face the challenge of correctly classifying income and expenses from crypto-asset trading. For individual investors and institutional entities, the key is not only the calculation of tax, but above all, the correct classification of the source of income, the point at which tax liability arises, and the costs of obtaining income. From the moment the first transaction is executed, the need arises to document the history of transactions, which, in the event of a tax audit, provides the foundation for secure settlement.
Unlike traditional financial instruments, professional crypto-asset consulting is based on a deep understanding of blockchain technology and the specifics of cryptocurrency exchanges. Our support includes settling profits from trading, staking, mining, and airdrops, taking into account specific income tax rules (PIT/CIT). Many aspects of the Web 3.0 industry, such as token issuance (ICO/IDO), trading in non-fungible tokens (NFTs), and remuneration paid in cryptocurrencies, raise significant questions regarding income tax and taxpayer obligations.
